The developer assumed a certain cashflow from signage that was part of their original business plan. Basic economics would reduce this to a question of rights and the value of those rights. The question is what is this value and whether residents are willing to compensate the developer fully or partially for the lost value.

Of course, this all assumes that the original POS package included the advertising plans. There seems to be some confusion over whether earlier packages did not include the advertising while later ones did. This needs to be clarified in terms of whose rights are being challenged.DCDNAhttps://www.blogger.com/profile/02596498159752818718noreply@blogger.comtag:blogger.com,1999:blog-6767983040675315267.post-31965905324633798382009-04-03T06:32:00.000-07:002009-04-03T06:32:00.000-07:00I know it is not 2003 anymore, but why should the ...I know it is not 2003 anymore, but why should the passage of six years make a difference? Things have changed downtown precisely because developers who had vision took risks and invested downtown. So why should they be penalized for their success and possibly have the rules re-written, which is what a reexamination" could lead to?

As you acknowledge, the plans for signage at Gallery Place was part of the developer's original business plan. Anyone who was paying attention would have known this when they bought. People get upset when the city changes the rules of the game for zoning exceptions, etc. It's often not fair. It's no more fair to change the rules of the game for developers, who take the greatest risk.Anonymousnoreply@blogger.com
